PXVIRT 终端用户许可协议 

使用PXVIRT软件即表示您接受本EULA，并且您已阅读并理解条款和条件。这也适用于代表实体行事的个人。本EULA不提供支持订阅服务作为软件维护、更新和支持的任何权利。请查阅支持订阅协议以了解这些条款和条件。本EULA适用于任何版本的PXVIRT以及任何相关的更新、源代码和结构（程序），无论其交付机制如何。PXVIRT基于Proxmox VE再次开发而成，属于Proxmox VE变体，由Lierfang进行驱动。PXVIRT 遵循 GNU Affero General Public License v3 (AGPLv3) 。PXVIRT包含了很多Proxmox公司的代码，在接受本EULA之前，您还应该遵守Proxmox的EULA。使用本软件即表示您同意以下条款。

1. 许可。您获得以下权利（需遵守 AGPLv3），运行、复制、修改、分发本软件（包括二进制和源代码形式），通过网络向第三方提供本软件服务时，必须公开相关源代码。本软件包含以下组件：
    a. Proxmox VE 原始代码（版权归 Proxmox Server Solutions GmbH 所有）。
    b. PXVIRT 增改部分（版权归 Lierfang（梨儿方） 所有）。
    c. 第三方软件包，你需要遵守第三方软件包的许可，如果你不同意，则不能安装他们。

2. 源代码要求。若您通过网络提供本软件服务，必须在服务启动时提供源代码获取途径（如网站链接），公开所有修改后的代码，包括您的自定义部分。

3. 商标与品牌。PXVIRT基于Proxmox VE，PXVIRT是Lierfang的品牌，Proxmox是Proxmox Server Solutions GmbH的商标，未均授权，均不可使用商标或者logo。

4. 保修免责。本软件按 "现状" 提供，不提供任何形式的担保，包括但不限于适销性、特定用途适用性或非侵权保证。

5. 责任限制。对于因使用本软件导致的直接或间接损失（如数据丢失、业务中断），Lierfang 不承担任何责任。最高赔偿金额不超过您支付的软件费用（如有）。

END USER LICENSE AGREEMENT (EULA) FOR PROXMOX VIRTUAL ENVIRONMENT (PROXMOX VE)

By using Proxmox VE software you agree that you accept this EULA, and that you have read and understand the terms and conditions. This also applies for individuals acting on behalf of entities. This EULA does not provide any rights to Support Subscriptions Services as software maintenance, updates and support. Please review the Support Subscriptions Agreements for these terms and conditions. The EULA applies to any version of Proxmox VE and any related update, source code and structure (the Programs), regardless of the delivery mechanism.

1. License. Proxmox Server Solutions GmbH (Proxmox) grants to you a perpetual, worldwide license to the Programs pursuant to the GNU Affero General Public License V3. The license agreement for each component is located in the software component's source code and permits you to run, copy, modify, and redistribute the software component (certain obligations in some cases), both in source code and binary code forms, with the exception of certain binary only firmware components and the Proxmox images (e.g. Proxmox logo). The license rights for the binary only firmware components are located within the components. This EULA pertains solely to the Programs and does not limit your rights under, or grant you rights that supersede, the license terms of any particular component.

2. Limited Warranty. The Programs and the components are provided and licensed "as is" without warranty of any kind, expressed or implied, including the implied warranties of merchantability, non-infringement or fitness for a particular purpose. Neither Proxmox nor its affiliates warrants that the functions contained in the Programs will meet your requirements or that the operation of the Programs will be entirely error free, appear or perform precisely as described in the accompanying documentation, or comply with regulatory requirements.

3. Limitation of Liability. To the maximum extent permitted under applicable law, under no circumstances will Proxmox, its affiliates, any Proxmox authorized distributor, or the licensor of any component provided to you under this EULA be liable to you for any incidental or consequential damages, including lost profits or lost savings arising out of the use or inability to use the Programs or any component, even if Proxmox, its affiliates, an authorized distributor and/or licensor has been advised of the possibility of such damages. In no event shall Proxmox's or its affiliates' liability, an authorized distributor's liability or the liability of the licensor of a component provided to you under this EULA exceed the amount that you paid to Proxmox under this EULA.

4. Intellectual Property Rights. The Programs and each components are owned by Proxmox and other licensors and are protected under copyright law and under other laws as applicable. The "Proxmox" trademark and the Proxmox company logo are registered trademarks of Proxmox in Austria and other countries. This EULA does not permit you to distribute the Programs or their components using Proxmox's trademarks, regardless of whether the copy has been modified. Title to the Programs and any component, or to any copy, modification, or merged portion shall remain with Proxmox and other licensors, subject to the applicable license.

5. Third Party Software. Proxmox may distribute third party software with the Programs. These third party programs are provided as a convenience to you, and are subject to their own license terms. If you do not agree to the applicable license terms for the third party software programs, then you may not install them.

6. Export Regulation. You warrant that you understand that the Programs and their components may be subject to export controls under the Austrian Export Administration Regulations.

7. Other terms. If any provision of this EULA is held to be unenforceable, the enforceability of the remaining provisions shall not be affected. Any claim, controversy or dispute arising under or relating to this EULA shall be governed by the laws of Austria (Europe), without regard to any conflict of laws provisions.
